چکیده
سیاست‌گذاری خانواده، از مصادیق ملموس رگولاسیون به معنای اخص آن است. نظریات و رویکردهای متفاوتی درباره رگولاسیون توسط دولت در نهاد خانواده، مطرح گردیده است. دولتین ایران و فرانسه با عطف توجه به نظریه دولت و مبانی نظری پشتیبان و توجیه‌کننده خویش، رگولاسیون خود را در نهاد خانواده، در دو نظام حقوقی ایران و فرانسه بر رعایت ملاحظاتی از قبیل تقدم منافع عمومی بر حقوق و منافع فردی، نظم عمومی و اخلاق حسنه، اصل پدرسالاری و اخلاق‌گرایی قانونی، حمایت از حقوق و آزادی‌های اشخاص (به ویژه حمایت از حقوق طرف ضعیف)، تضمین کرامت انسانی و اصل برابری، تضمین عدالت و استناد به اصل ضرر، توجیه می‌سازند. بدیهی است که چگونگی، میزان (حدود و ثغور) و مبانی (شاخص‌ها و معیارهای) رگولاسیون در نهاد خانواده در دو نظام حقوقی ایران و فرانسه، علی‌رغمِ وجود برخی تشابهات، تفاوت‌های بنیادین با یکدیگر دارد.

نهاد خانواده در نظام‌های حقوقی ایران و فرانسه، از رگولاسیون توسط دولت مصون نیست؛ اما این رگولاسیون باید جنبه استثنایی، تنظیم‌گرایانه، حداقلی و مبتنی بر ضرورت، عقلانیت و قانون داشته باشد. رگولاسیون در نهاد خانواده، نباید به شیوه تصدی‌گری و حداکثری باشد، بلکه باید جنبه حمایتی و حداقلی داشته باشد.

بحث بر سر این است که رگولاسیون در حوزه خانواده به چه شیوه و تا چه مرزی قابلیت پذیرش دارد. مساله اصلی این پژوهش از اصل مشروعیت رگولاسیون بر نحوه و حوزه رگولاسیون توسط دولت و همچنین میزان و حدود و ثغور این رگولاسیون، متمرکز است.

چکیده [English]
Family policy is a remarkable example of regulation in its special meaning. There are different theories and approaches to regulation in the Institution of family. In consideration of the state theory and the supporting theoretical basis, Iran and France’s States, have justified their family regulation based on the prioritizing public interest on individuals, public order and good morals, legal paternalism and legal moralism, protecting the rights and individual freedoms, especially for the minorities, guarantying human’s dignity, equality, justice, and considering The Harm Principle. However, there are fundamental differences between the two legal systems despite some similarities in the quality, the scope, and the basis (criteria) of the regulation in the Institution of family. Although the family is included in the governmental regulation, this needs to be exceptional, regulatory, protective, minimal, and based on the necessities, rationality, and law. The question of the survey besides the legitimacy of the regulation is about the methods and the territory of the family regulation.
